WHO WE ARE
The Associação de Turismo do Porto e Norte, A.R. – Porto Convention & Visitors Bureau is a non-profit organization founded in 1995, whose mission is to develop and promote Porto and Northern Portugal as a tourist destination abroad. It plays a key role in shaping the region’s image and reputation in international markets.
ATPN owns the domain https://booking.visitportoandnorth.travel, where this platform and the services provided through the ATPN Marketplace (hereinafter, MARKETPLACE) are hosted.

2. WHAT IS THIS POLICY ABOUT?
2.1. This Privacy Policy explains how we collect and process personal data necessary for the provision of the MARKETPLACE and the services available through it.

2.2. Examples of such services include:
Promotion of the products, goods, and services of Partners;
Registration on the MARKETPLACE;
Provision of benefits to Users;
Subscription to regular communications about general and personalized benefits and/or offers;
Purchase of products, goods, and/or services from Partner Sellers.

2.3. The goal is to provide the MARKETPLACE and its services efficiently, without inconvenience, and in compliance with applicable laws, describing the practices adopted to achieve this.

3. WHAT IS PERSONAL DATA?
3.1. Personal data includes any information (regardless of its nature or format) relating to a person that identifies that person.

3.2. It also includes information that makes a person identifiable.

3.3. "Identifiable" refers to a person who can be identified, directly or indirectly, particularly by reference to an identification number or to specific elements of their physical, physiological, mental, economic, cultural, or social identity.

3.4. Examples of personal data we collect include: “name,” “email,” “tax ID number,” or “address.”

4. JOINT PROCESSING WITH SELLERS
4.1. CONTEXT:
ATPN will jointly process personal data with the selected PARTNER(S) under the terms described below.

4.2. PURPOSES:
ATPN and the PARTNER(S) act as joint controllers solely for the processing of personal data of Users/Consumers who use the Porto and Northern Portugal Tourism MARKETPLACE to purchase products, goods, and/or services from such SELLER(S).

4.3. OTHER PURPOSES:
If ATPN and/or the PARTNER(S) use the data for purposes not stated here, each party shall be considered a separate and independent data controller and must comply with their own obligations under privacy and data protection legislation.

4.4. LEGAL BASIS FOR PROCESSING:
Purchase of products, goods, and/or services from the SELLER(S):

Performance of a contract to which the Data Subject is a party;
Legal obligations applicable to ATPN and the PARTNER(S).

4.5. TRANSPARENCY:
Information regarding the processing of personal data related to the purchase of products, goods, and/or services from the PARTNER(S) is provided by ATPN.

4.6. DISCLOSURE:
ATPN and the PARTNER(S) may disclose personal data to third parties in compliance with legal obligations or to data processors.

4.7. INTERNATIONAL TRANSFERS:
By default, ATPN and the PARTNER(S) do not transfer data to countries outside the European Union. If such a transfer is required, measures will be taken to ensure that the level of protection provided under European legislation is maintained, namely through appropriate safeguards.

4.8. PROCESSORS:
ATPN and the PARTNER(S) may subcontract service providers bound by data processing agreements in accordance with the GDPR, applicable laws, and best practices.

4.9. EXERCISING RIGHTS:
Rights may be exercised as outlined in Section 12 of this Policy. Responses to rights requests concerning processing under this agreement are the responsibility of the SELLER(S), who must inform ATPN. ATPN will fulfill its duty to assist and cooperate with the SELLER(S) in responding to such requests.

4.10. PERSONAL DATA BREACH:
In the event of a data breach, ATPN and the PARTNER(S) agree to cooperate and provide assistance. Notwithstanding, any breach occurring due to the operation of the MARKETPLACE will be notified and reported by ATPN.
